The Federal High Court Abuja, on Tuesday discharged a 75-year old man, Ibrahim Shehu, on a one-count charge of unauthorised possession of a narcotic substance.
Shehu, who was arraigned by the National Drug Law Enforcement Agency (NDLEA) on a one-count charge of possessing 300 grammes of cannabis sativa (aka indian hemp), pleaded guilty to the charge.
The prosecuting counsel, Ms A.M Okon, prayed the court for an adjournment to enable her review the facts of the case following the defendant’s guilty plea.
She also prayed the court for an order remanding him at the Kuje Correctional Centre, pending the review of facts since the prosecution was unable to produce the exhibits in court on Tuesday.
The defence counsel, Mr J.C Alum, however, prayed the court to discharge the defendant since it appeared that the prosecution was not ready to prosecute the case.
The Judge, Justice Mobolaji Olajuwon in a short ruling, held that she would not remand the accused because of his age.
The judge, however, cautioned him to desist from such act, warning that if he was ever arrested again for drug possession, the court would no longer be lenient with him.
