The Economic and Financial Crimes Commission (EFCC) has disclosed that it will appeal the dismissal of its case against Babachir Lawal.
The former Secretary to the Government of the Federation defeated the anti-graft agency in court on Friday.
Justice Charles Agbaza of the Federal Capital Territory (FCT) High Court dismissed the corruption charges against Lawal alongside his brother and others.
The former SGF, his brother Hamidu David Lawal, Suleiman Abubakar and Apeh John Monday are being prosecuted by the anti-graft agency alongside Rholavision Engineering and Josmon Technologies as fifth and sixth defendants in the suit.
The amended 10-count charge against them includes fraud, diversion of funds and criminal conspiracy to the tune of over N544million.
Justice Agbaza while delivering his judgement on Friday ruled that the commission, which presented 11 witnesses, failed to establish the ingredients of the alleged offence.
The judge said the EFCC did not prove that Lawal was either a member of the Presidential Initiative for North East (PINE), the contract issuer, or a Ministerial Tenders Board that vetted and gave approval to the disputed contract.
Reacting to the judgement, EFCC in a statement signed by the spokesperson, Wilson Uwujaren disclosed that the agency would review the judgment and challenge its validity at the appellate court.
“But dissatisfied with the ruling, the EFCC has given indication that it will obtain a copy of the judgment for urgent review and challenge its validity at the appellate court,”the agency disclosed
