The family of late Oluwabamise Ayankola, has rejected the autopsy plan by the Lagos State Government.
Bamise, 22 year old had boarded a BRT bus from Lekki to Oshodi last month but was later declared missing by her family.
She was found dead on Carter Bridge Lagos three days after intensive search.
The driver of the bus, Mr. Nice Omonnikoron was later arrested in Ogun State where he was hiding.
Lawyer to the family at a press conference on Friday said there is no way the Lagos State Government which is a party to the matter can be the one to provide a pathologist in a case in which it is a party.
“You cannot be a pathological judge in your own case,” said the lawyer, Ayo Ademiluyi
He said the family got a invitation on Wednesday to attend an autopsy session slated to be conducted on Thursday.
He said apart from the short notice, there was no way they could take part in an exercise they did not trust.

“We received an invitation from police that we should come for autopsy a day before it would be performed.
“We rejected it because it will only be conducted by the appointed officials of Lagos State Government alone.
“Lagos State is a party in this case, they cannot be a judge in their own case, they can only be witnesses or observants.
“It is better for them to invite pathologists that are neutral in this case,” he said.
The lawyer insisted that the state Government is the owner and employers of the driver who has been accused of conniving with others to kill Bamise.
He said the family would request for two weeks within which to assembly their own pathologists to work on the autopsy on Bamise.
The lawyer said the Lagos State Government is also free to invite its own pathologist to be part of the autopsy as part of efforts to establish the true cause of the death of Bamise.
