The Economic and Financial Crimes Commission (EFCC) has appealed the judgment of the Federal Capital Territory (FCT) High Court, Abuja, which awarded N10 million in damages to former Minister of Power, Olu Agunloye.
NPO reports that this follows a social media publication linking him to the alleged $6 billion Mambilla Power Project fraud.
The commission filed its notice of appeal at the Court of Appeal, Abuja, on Friday, July 10, 2026, through its counsel, Wahab Shittu (SAN).
According to the notice of appeal in Suit No. FCT/HC/CV/1199/2024, the EFCC is challenging the entire judgment delivered by Justice Peter Kekemeke of the FCT High Court on July 8, 2026.
The anti-graft agency expressed dissatisfaction with the ruling, which held that its publication about Agunloye was false, defamatory and damaging to the former minister’s reputation.
The appeal is based on 11 grounds and seeks four principal reliefs, including an order setting aside the judgment of the lower court, dismissing Agunloye’s suit in its entirety and granting any further orders the appellate court considers appropriate.
Justice Kekemeke had ruled that the EFCC’s publication defamed Agunloye and awarded him N10 million as damages.
In addition to the appeal, the commission has also filed an application seeking a stay of execution of the High Court judgment pending the determination of the appeal.
However, no date has been fixed for the hearing of the appeal.
