The Kaduna State Governorship Election Petition Tribunal on Thursday ruled that the governorship election held in state this was inconclusive.
It therefore ruled against the Governor Uba Sanni was not the winner of the election as declared by the Independent National Electoral Commission.
The petition was filed by the Peoples Democratic Party (PDP) and its candidate, Isah Mohammed Ashiru.
The judgement was delivered by the court via zoom on Thursday.
In a split decision of a ratio of 2:1, the three-man tribunal panel led by Justice Victor Oviawe declared that the election was inconclusive and thus directed that a supplementary election should be held by the Independent National Electoral Commission within 90 days.
The tribunal ruled further that INEC is to conduct election in seven wards, four local govts, 24 polling units consisting of 16,300 registered voters.
However the tribunal, having ruled considered the petition of the PDP candidate abandoned said this would not be enough to nullify the election of the Governor.
Giving further details on the decision of the tribunal, counsel to the Governor, Sunusi Musa SAN, said that the APC had filed before the tribunal alleging that PDP had abandoned its petition as far back as May 30 this year.
He said the tribunal agreed with the Sani’s legal team that the PDP had indeed abandoned its petition but went on to say that elections were canceled in about 16,000 polling units which would have made the election inconclusive.
But having abandoned the petition, the counsel said that the inconclusive status of the election had become immaterial in the eyes of the law.
